Dual Advent Calendar 2021 competition

1. Object

1.1

The “Advent Calendar 2021” competition is organised by Dual GmbH, represented by its Managing Director Dr. Josef Zellner, Graf-Zeppelin-Str. 7 in 86899 Landsberg am Lech, Germany.

1.2

The “Dual Advent Calendar 2021” is held in the period from 01.12.2021 – 24.12.2021 to 23:59 hrs and includes a daily competition.

The respective entry deadline and rules vary; these will always be announced with the respective competition entry.

The draw and contacting of the winner will take place on the following day. (With the exception of Saturday and Sunday, the winners of the weekend competitions will always be announced and contacted on the following Monday).

1.3

Participation is voluntary and free of charge. Participation and the chances of winning are independent of the purchase of goods.

1.4

By entering the competition, the contestant accepts all terms and conditions of entry as well as the Terms of Use, Data Policy and Community Standards of Meta Platforms, Inc. available at https://www.facebook.com/policies_center.

1.5

The Competition is not affiliated with, sponsored, endorsed or organised in any way by Facebook or Instagram. Any questions, comments or complaints should not be directed to Facebook or Instagram but directly to Dual.

By confirming the terms and conditions of entry, contestants acknowledge that they cannot acquire any claim against Meta Platforms, Inc. if they enter the competition.

2. Participation/procedure

2.1

Participation can only take place via the Internet and requires a profile in the social networks “Facebook” and/or “Instagram”. (www.facebook.com / www.instagram.com).

2.2

Participation takes place by liking the original competition entry and commenting on it on the Facebook or Instagram company page Dual, exact conditions will be published directly in the entry. In addition, it is assumed that the participants have subscribed to the Facebook and/or Instagram page of the company.

2.3

People who have reached the age of 14 are eligible to participate. Employees of Dual GmbH, their relatives and all persons involved in the creation and implementation of this competition are excluded from participation.

2.4

It is permitted to try one’s luck at all 24 chances to win, however, only one entry per person per day is permitted. (One entry per platform is permitted – i.e. people who have a Facebook and Instagram account may also enter on both platforms).

In the event of multiple comments under a competition entry, only the last (current) comment will be taken into account and further comments will be removed/hidden without exception.

2.5

Participation via competition services, automated mass participation procedures of third parties, via agencies or via other commercial providers is not permitted.

2.6

In the event of a breach of these conditions of participation, Dual reserves the right to exclude the participant from the competition. In such cases, prizes may be subsequently withdrawn and reclaimed.

3. Determination of the winners

3.1

There are a total of 24 prizes to be won, i.e. 24 competition entries per platform (Facebook, Instagram). There will be one winner per day, per platform and each prize will be drawn only once to one person.

This person will be drawn at random.

3.2

The winners will be informed about the prize via a personal Facebook or Instagram message to their profile and will be asked to send their contact details (first and last name, address) to media@dual.de for the postal transmission of the prize.

In addition, the winner’s Facebook or Instagram username will be published in a post on Facebook/Instagram. By participating in the competition, the person agrees to this!

4. Prize

4.1

The winner will receive the daily prize from the “Advent Calendar” which will be announced on Facebook and Instagram. A total of 24 (twenty-four) winners will be selected.

4.2

Prizes will be sent by Dual or a third party commissioned by Dual by a forwarding agent such as a parcel service or a postal service to the given address. The delivery costs shall be borne by Dual.

4.3

Cash payment of the prizes or any substitute prize is not possible. The claim to the prize is not transferable.

5. Rights to uploaded/published content

5.1

The content/comments published by the participant may not be illegal, in particular may not contain false factual allegations or insults or infringe intellectual property rights to which third parties are entitled (e.g. trademark rights, copyrights). If a third party claims such an infringement through a comment, the user shall indemnify us against the claims of the third party. The indemnification also includes the lawyer’s fees for the defence against such third party claims, if necessary.

Dual reserves the right to delete entries/comments from participants or to exclude them from the competition if they violate any of the aforementioned provisions.

5.2

By commenting on the entry, the participant declares that the content contained in the comment is free of third-party rights.

The participant also assures that no other rights of third parties, in particular no copyrights, personal rights or trademark rights, are violated by the contribution/comment and that the contribution does not contain any content that glorifies violence, is relevant under criminal law, is pornographic or otherwise offensive or violates the law. No commercial or political advertising may be published either.

5.3

The participant indemnifies Dual against all claims which third parties may have or should have against Dual as a result of the entry. He/she also agrees to support Dual at any time in a reasonable manner in the defence against such claims. Further claims for damages by Dual against the participant remain unaffected.

5.4

Dual is not obliged to check the contribution/comment published by a participant for potential infringements of the rights of third parties. However, Dual is entitled to reject contributions/comments, delete contributions/comments or exclude the participant from participation at any time and without explanations or prior notice if, in the proper assessment by Dual, a contribution/comment is illegal, offends common decency or is otherwise inappropriate.

6. Data protection/consent to the use of personal data

6.1

The prerequisite for participation in the competition is that the participant marks the competition entry(s) for the “Dual Advent Calendar 2021” on our Facebook and/or Instagram company page in accordance with section 2.2 with Like Me and comments as well as subscribes to the Facebook and/or Instagram company page.

The profile names of the participants will be used by Dual to assign the comments and – in the event of a win – to contact the winner via a personal message. (Notification of win/win processing)

In the event of a win, the first name, surname and postal address of the winner must be given to Dual. This data will be used by Dual GmbH exclusively for prize processing and for sending the prize by post.

6.2

By participating in the Advent Calendar 2021 competition, participants consent to the processing and use of personal data for the purpose of conducting the competition.

Your consent also includes your agreement to be contacted in the event of your winning by Facebook or Instagram message to your Facebook or Instagram profile through which you entered the competition.

6.3

In the event of a prize, your data will be passed on to the shipping company commissioned with the delivery.

Your personal data will not be transferred to other third parties or used for other advertising purposes without your consent, unless we are legally obliged to disclose data.
